Comptroller Reports State Contracts and Payments for December

In December, the NY Office of the State Comptroller approved 2,332 contracts for state agencies and public authorities valued at $75.6 billion and approved nearly 1.8 million payments worth more than $15.6 billion. The office rejected 212 contracts and related transactions valued at $15.4 billion and nearly 1,800 payments valued at nearly $12.6 million, primarily for mistakes, insufficient support for charges, and improper payments. Major Contracts Approved

Office of General Services – Design & Construction

  • $12.1 million with Global Electrical Contracting of Westchester Inc. to provide a closed-circuit television and alarm system at the Taconic Correctional Facility in Westchester County.
  • $3.5 million with DLC Electric LLC to replace the fire alarm system in building 22 at the Harriman State Office Building Campus in Albany County.
  • $2.9 million with Michael A. Ferrauilo Plumbing and Heating Inc. to rehabilitate the boilers and make HVAC modifications at the Office of Children and Family Services Industry Secure Center in Monroe County.
  • $1.4 million with TAM Enterprises Inc. to replace manholes and provide pump station upgrades at the Highland Residential Center in Ulster County.
  • $1.1 million with Schenectady Hardware & Elec. Co. to replace lighting and controls at the State Office Building in Schenectady County.

Office of Parks, Recreation and Historic Preservation

  • $6.2 million with M. Scher & Son Inc. for rehabilitation of the electric system at the Saratoga Spa State Park in Saratoga County.
  • $5 million with Arcadis of New York Inc. for construction management services at the John Jay Homestead Historic Site in Westchester County.
  • $2.5 million with Merritt Construction Inc. for septic system improvements at the Mills Norrie State Park in Dutchess County.
  • $1.1 million with LaValley Bros Construction Inc. for petroleum storage tank replacement at various locations throughout New York.

State University of New York

  • $8.9 million with Dyntek Services Inc. for Crowdstrike software at several campuses.
  • $3.4 million with Titan Roofing Inc. for a roof replacement on Laker Hall at SUNY Oswego.
  • $2.1 million with Kimball & Kimball Companies Inc. for snow removal and ice control at SUNY Upstate Medical University.
  • $1.8 million with EL Ames Inc. for upgrades to the Cardiology Department at SUNY Upstate Medical University.
  • $1.3 million with O’Connell Electric Co. for Alumni Arena lighting replacement at the University at Buffalo.
  • $1.1 million with Schindler Elevator Corp. for preventive maintenance, inspection and testing of elevators at SUNY Cortland.

State University Construction Fund

  • $7.2 million with Troy Boiler Works Inc. for the rehabilitation of generators at SUNY New Paltz.
  • $1.7 million with LeChase Construction Services LLC for construction management services to renovate the Campus Center at the SUNY Polytechnic Institute Utica Campus.
  • $1.6 million with Labella Associates DPC for design work related to the renovation of Hartwell Hall at SUNY Brockport.
  • $1.1 million with Northern Tier Contracting Inc. for construction of an elevator in Flag Hall at SUNY Potsdam.

Department of Transportation

  • $46.9 million with Lancaster Development & Tully Construction Co. for pavement rehabilitation and bridge deck replacement on Route 17 in Tioga County.
  • $27.8 million with Cold Spring Construction Co. for highway improvements and paving on Route 104 in Monroe County.
  • $10.8 million with H&L Contracting LLC for highway safety improvements in Suffolk County.
  • $8.6 million with Oliveira Contracting Inc. for bridge maintenance and repairs on various routes in Suffolk County.
  • $2.1 million with Lockwood Kessler & Bartlett Inc. for construction inspection services in Suffolk County.

Tax Refunds and Credits

  • $627.2 million for 15,931 personal income tax refunds.
  • $134.2 million for 132,020 property tax credits.
  • $116.8 million for 17,377 corporate and other tax refunds.

Department of Civil Service

  • $387.9 million to CaremarkPCS Health LLC to provide pharmacy benefit services for the Empire, Excelsior, and Student Employee Health plans.
  • $28 million to Carelon Behavioral Health for benefit services for the Mental Health & Substance Abuse Program of the Empire Plan.

State Education Department

  • $1.4 billion to 510 school districts for general aid.
  • $993 million to 625 school districts for school-aged special education excess cost aid.

Empire State Development Corporation

  • $75 million to WolfSpeed Inc. for a portion of the design, construction, fit-out and equipping costs of a Silicon Carbide Semiconductor Device Manufacturing facility in Marcy, N.Y.
  • $2.5 million to the Tom James Co. for working capital to acquire the former Hickey Freeman Tailored Clothing company and its manufacturing facility, machinery and equipment in Rochester, N.Y.

Office of General Services

  • $12.3 million for hourly-based IT services, including $2.7 million to Knowledge Builders Inc., $1.1 million to MVP Consulting Plus Inc., and $8.5 million to 28 other vendors.

Department of Health

  • $46 million to Maximus Inc. for assistance with the Health Benefit Exchange, including insurance enrollment and call center operations.
  • $28 million to Maximus US Services Inc. for enrollment broker services for the Office of Health Insurance Programs.
  • $10.9 million to One Brooklyn Health System Inc. for the Health Care Facility Transformation Program in Kings County.
  • $2.7 million to Currier McCabe & Associates Inc. for the development, implementation, and operation of the Medicaid data warehouse and the Office of Health Insurance Programs Data Mart.

Division of Homeland Security and Emergency Services

  • $9.6 million to New York City for the Urban Area Security Initiative Program.
  • $2.9 million to the Port Authority of New York and New Jersey for the Urban Area Security Initiative Program.

Department of Labor

  • $239.9 million for payments under the Unemployment Insurance, Pandemic Unemployment Assistance, Mixed Earner Unemployment Compensation programs, and Federal Pandemic Unemployment Compensation programs.

Office of Temporary and Disability Assistance

  • $31.6 million for the Emergency Rental Assistance Program.

Department of Transportation

  • $6.4 million to EE Cruz & Company Inc. to replace Bronx River Parkway bridge in Bronx County.
  • $4.9 million to El Sol Contracting ES/II Enterprises JV for bridge repairs and painting on the Gowanus Viaduct Expressway in Kings County.

Other Contract and Payment Rejections and Other Cost Recoveries

DiNapoli’s office rejected tax refunds and credits valued at nearly $1.4 million. Auditors also recovered nearly $397,000 from vendors owing debts to the state and held nearly $98,000 in payments pending resolution of disputes between subcontractors and prime contractors.

Cumulatively through December for calendar year 2023, DiNapoli’s office approved 24,015 contracts valued at $140.8 billion and approved nearly 29 million payments worth more than $186 billion. The office rejected 2,113 contracts and related transactions valued at nearly $22.9 billion and more than 39,300 payments valued at nearly $224.6 million primarily due to errors, improprieties, or lack of documentation.
